Comprehensive Zoning Bylaw Review
Zoning by-laws are a set of regulations governing land uses that implement the policies in the Official Plan. A Zoning by-law contains specific requirements that provides a way of managing land use and future development that is legally enforceable. It also protects property owners from conflicting land uses. Zoning by-laws cover such items as the use of land, where buildings and other structures may be located, the types of buildings that are permitted and how they may be used, lot sizes and dimensions, parking requirements, landscape and buffer requirements, building heights and setbacks from property lines. Zoning b-ylaws are regulated by Section 34 of the Ontario Planning Act.
The parent zoning by-law for the Town of Newmarket is By-Law Number 2010-40 which governs land uses within the Town's municipal boundaries. The bylaw divides the municipality into different land use zones, with detailed maps. The map symbol (e.g., R1), on the zoning map is used to locate uses and standards for a specific property. On occasion, special exceptions or restrictions to a property may apply, therefore it is recommended that zoning inquires be directed to the Planning Department.
Zoning Bylaw Amendments and Applications
Section 34 of the Ontario Planning Act gives the Council for the Town of Newmarket the authority to adopt Zoning bylaws in conformity with its Official Plan. Zoning amendments provide a way to change zoning regulations for individual properties. By-Law 2010-40
The Town of Newmarket Council adopted the comprehensive Zoning By-Law 2010-40 on June 1, 2010. The By-Law including all Schedules are located below.
The Zoning By-Law is applicable to all lands in Newmarket except for those lands noted on the following map:
