Fences

No person in a residential area shall erect or construct a fence in the Town of Newmarket in excess of the height requirements set out.

1. Rear Yard: No fence erected in a rear yard shall exceed 1.8 metres (6 feet) in height provided that in the case of a corner lot, where a rear yard abuts a front yard or interior side yard of an adjacent lot, no person shall construct a division fence that exceeds 1.5 metres (5 feet) in height.
2. Front yard: No fence erected in a front yard shall exceed 1.0 metres (3 feet) in height.
3. Interior Side Yard: No fence erected in an interior side yard shall exceed 1.5 metres (5 feet) in height provided that if the fence is located in the interior side yard between two properties, the fence shall not exceed 1.5 metres (5 feet) in height and may be erected to a point opposite the front corner of the building nearer the road.
4. Exterior Side Yard: No fence erected in an exterior side yard shall exceed 1.5 metres (5 feet) in height provided that where a driveway adjacent to a fence which abuts a municipal sidewalk, the Owner shall install a 4.5 metre (15 foot) sight triangle.
