All swimming pools and hot tubs within the Town of Newmarket that can hold 0.6 metres (two feet) of water will require an enclosure. All enclosures require a permit and must comply with the Town's Pool Enclosure By-law 2008-18. Swimming Pool Enclosure Permit Process
In order to obtain a Swimming Pool Enclosure Permit, the following documents must be provided to the Legislative Services department at the Municipal Offices.
Assumed RoadsIn ground Pools, on ground pools and/or Machinery going over Town Blvd
- Completed Swimming Pool Enclosure Permit Application Form
- Two copies of the property site plan showing the proposed location of the swimming pool and equipment in relation to property lines, buildings and easements (these may be hand drawn)
- Completed Undertaking and Indemnification Form
- Pool Permit Fee, Boulevard Inspection Fee, and Deposit as prescribed in the Town's Fees By-law
- *New* ROP (Obtained through Operations Department)
- If access through Town Property is required, such as a park or walkway, approval is required through Legal Services
Above ground pools or Hot tubs and no Machinery going over Town Blvd
- Completed Swimming Pool Enclosure Permit Application Form
- Two copies of the property site plan showing the proposed location of the swimming pool and equipment in relation to property lines, buildings and easements (these may be hand drawn)
- Pool Permit Fee as prescribed in the Town's Fees By-law
- *New* Check with Operations Department to determine if an ROP is required
- If access through Town Property is required, such as a park or walkway, approval is required through Legal Services
Unassumed RoadsAny type of Pool or Hot tub - Completed Swimming Pool Enclosure Permit Application Form
- Two copies of the property site plan showing the proposed location of the swimming pool and equipment in relation to property lines, buildings and easements (these may be hand drawn)
- Pool Permit Fee as prescribed in the Town's Fees By-law
- Completed and signed Developer's Clearance Letter
- If access through Town Property is required, such as a park or walkway, approval is required through Legal Services
